Overview

Lumina Studio ("we," "us," or "our") respects the intellectual property rights of others and expects users of our AI-powered image transformation service to do the same. This Digital Millennium Copyright Act ("DMCA") policy outlines our procedures for handling copyright infringement claims in accordance with the DMCA, 17 U.S.C. § 512.

We respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. We will remove or disable access to content found to be infringing.

What Constitutes Copyright Infringement

Copyright infringement occurs when someone uses copyrighted material without permission from the copyright holder. On Lumina Studio, this may include:

Uploading images that you do not own or have permission to use
Using AI-generated outputs that incorporate copyrighted elements without authorization
Reproducing, distributing, or publicly displaying content that belongs to others
Creating derivative works from copyrighted material without permission

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our DMCA Agent with the following information:

Required Information:

1. A physical or electronic signature of the copyright owner or authorized agent
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the infringing material and its location on our service (URL)
4. Your contact information (address, telephone number, email)
5. A statement that you have a good faith belief that the use is not authorized
6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

Counter-Notice Procedure

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

Your physical or electronic signature
Identification of the removed material and its former location
A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
Your name, address, telephone number, and a statement consenting to jurisdiction of the federal court in your district

We will forward counter-notices to the original complainant. If no legal action is taken within 10 business days, we may restore the removed content.

Important Notice

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorney fees.

Filing a false DMCA claim or counter-notice is a serious legal matter. Please ensure you have a valid basis before submitting either.

Repeat Infringer Policy

We will terminate the accounts of users who are repeat copyright infringers in appropriate circumstances. We maintain a record of DMCA notices and may permanently suspend accounts after multiple valid infringement claims.
