Agreement to Terms

Welcome to Lumina Studio. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Lumina Studio ("we," "us," or "our") regarding your access to and use of our AI-powered Hanfu style transfer platform (the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

Eligibility

By using our Service, you represent and warrant that you:

Are at least 18 years of age, or have obtained parental or guardian consent
Have the legal capacity to enter into a binding agreement
Have the right to grant the licenses described in these Terms for any content you submit
Will comply with all applicable laws and regulations

Account Registration

To access certain features of the Service, you may be required to create an account. When registering for an account, you agree to:

•Provide accurate, current, and complete information during the registration process
•Maintain and promptly update your account information
•Keep your password confidential and secure
•Notify us immediately of any unauthorized use of your account
•Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided during registration proves to be inaccurate, not current, or incomplete.

User Content and Intellectual Property

Your Uploaded Photos

You retain all ownership rights to the photos you upload to the Service ("User Content"). However, by uploading photos, you grant Lumina Studio a limited, non-exclusive, worldwide, royalty-free license to:

•Process, store, and transmit your photos for the purpose of generating AI-powered Hanfu-style portraits
•Display your generated portraits in your personal gallery for 7 days
•Use technical processes necessary to provide the Service (compression, format conversion, etc.)

This license is limited to providing the Service and does not include the right to sell, distribute, or publicly display your User Content for commercial purposes without your explicit consent.

AI-Generated Portraits

You own the AI-generated Hanfu portraits created from your uploaded photos ("Generated Content"), subject to the following conditions:

•You have the right to use, download, and share your Generated Content for personal and commercial purposes
•Generated Content may contain watermarks or attributions to Lumina Studio
•We reserve the right to display your Generated Content in our public gallery with your consent
•You acknowledge that AI-generated content may have unique characteristics and limitations

Lumina Studio Property

The Service, including its original content, features, functionality, logos, trademarks, and design, is owned by Lumina Studio and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use, copy, modify, distribute, or create derivative works of our content without explicit written permission.

Acceptable Use Policy

Prohibited Activities

You agree NOT to use the Service to:

✕Upload content that infringes any third-party rights (copyright, trademark, privacy, etc.)

✕Upload photos of other individuals without their explicit consent

✕Generate content that is unlawful, harmful, threatening, abusive, or defamatory

✕Create content depicting minors in any inappropriate context

✕Use the Service for any commercial purpose without our written permission

✕Attempt to gain unauthorized access to the Service or user accounts

✕Interfere with or disrupt the Service or servers

✕Reverse engineer, decompile, or disassemble the Service

✕Use automated systems (bots, scrapers) to access the Service

✕Circumvent any usage limits or payment requirements

Violation of these prohibited activities may result in immediate suspension or termination of your account without notice or refund.

Payment and Refunds

Pricing

•All prices are in USD unless otherwise stated
•Prices may change at any time without prior notice
•Price changes will not affect active subscriptions until renewal
•Free quota is non-transferable and expires after 30 days

Payment Processing

Payments are processed by third-party payment providers (Stripe, Alipay, WeChat Pay). By making a purchase, you agree to the payment provider's terms and conditions.

•All payments are processed securely by licensed payment providers
•You authorize us to charge your selected payment method
•Recurring subscriptions will auto-renew unless cancelled
•Failed payments may result in service suspension

Refund Policy

•Free quota: Non-refundable and non-transferable
•Paid quota: Refundable within 7 days of purchase if unused
•Subscription plans: Refundable within 7 days if no images generated
•After 7 days: No refunds except as required by law
•Technical failures: Full refund or credit if Service cannot be delivered

Account Termination

You May Terminate

•Delete your account at any time via Account Settings
•Stop using the Service at any time
•Request data deletion upon account termination
•Receive pro-rated refund for unused paid quota (within 7 days)

We May Terminate

We reserve the right to suspend or terminate your account immediately, without prior notice, for:

•Violation of these Terms or Acceptable Use Policy
•Fraudulent or abusive behavior
•Non-payment or payment disputes
•Extended inactivity (12+ months)
•Legal requirements or regulatory compliance

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Disclaimers and Limitations

AI-Generated Content Notice

You acknowledge that the Service uses artificial intelligence to generate Hanfu-style portraits. AI-generated content:

•May contain artifacts, inconsistencies, or unexpected results
•Is not guaranteed to accurately represent any individual or likeness
•May not be suitable for all commercial or professional uses
•Should be reviewed before any public or commercial use

No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINA STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO LUMINA STUDIO IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Lumina Studio, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

•Your violation of these Terms
•Your use of the Service
•Your User Content or Generated Content
•Your violation of any third-party rights
•Your violation of any applicable laws or regulations

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Lumina Studio operates, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved as follows:

Informal Resolution: Contact us at legal@nichang.cc to attempt informal resolution
Mediation: If informal resolution fails, parties agree to participate in non-binding mediation
Arbitration: If mediation fails, disputes shall be resolved by binding arbitration
Court Proceedings: Nothing prevents seeking injunctive relief in court

Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

•Posting the updated Terms on this page
•Updating the "Last updated" date
•Sending email notification for material changes (if email provided)
•Displaying a notice in the Service

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree with the modified Terms, you must discontinue use of the Service.
